HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.15004 OF 2015 ORDER:

Heard the learned counsel for petitioner and the learned Government Pleader for the respondents.

The petitioner states that he was granted Form 2B licence bearing No.1 of 2006-07 and he was running Bar and Restaurant in the name and style of M/s. Blue Restaurant and Bar and subsequently it was changed to M/s. AVR Neo Restaurant and Bar. The licence was renewed for the year 2014-15. While so, the third respondent passed an order on 30.04.2015 in proceedings in R.C.No.37/2015/A1 suspending licence with immediate effect pending enquiry in the case and ordered closure of the bar until further orders of the Commissioner of Prohibition and Excise, A.P., Hyderabad, while issuing a show cause notice for cancellation. The petitioner states that he submitted an explanation on 05.05.2015.

In the circumstances, the third respondent is directed to consider the explanation submitted by the petitioner on 05.05.2015, if it was received by him, within a period of one (1) week from the date of receipt of a copy of the order and pass appropriate orders thereon in accordance with law. The Writ Petition is accordingly disposed of. There shall be no order as to costs. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed.
