THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.24163 OF 2000 ORDER:
The learned Counsel for the petitioner submits that the petitioner was removed by the 1st respondent-employer and the said order of removal was challenged before the Labour Court and the Labour Court passed a nil award, and challenging the nil award passed by the Labour Court, the present writ petition has been filed. The writ petition was dismissed for default against the 1st respondent-employer, who is the contesting respondent, way back in the year 2009 i.e., on 9.4.2009 and the petitioner has not taken steps to restore the writ petition against the 1st respondent, who is the contesting party in the case.
No lis can be adjudicated in the present case in view of dismissal of the writ petition against the 1st respondent in the year 2009 and no useful purpose would also be served in adjudicating the case in view of fact that the 1st respondent was no more a party to the writ petition, and therefore, the writ petition is devoid of merits. Accordingly, the Writ Petition is dismissed. Consequently, all the applications, in the writ petition, are also dismissed. No costs.
