THE HON'BLE Dr. JUSTICE SHAMEEM AKTHER CIVIL REVISION PETITION No.1999 of 2019 ORDER:

This civil revision petition is filed under Section 115 of C.P.C, by the petitioner/Judgment Debtor, aggrieved by the orders passed in E.P.No.6 of 2017 in O.S.No.144 of 2005 by the Principal Junior Civil Judge, at Kodad.

2) Heard the learned counsel for the revision petitioner and perused the record.

3) The Court below passed a detailed order dated 18.03.2019 in E.P.No.6 of 2017 narrating valid reasons and issued warrant against the revision petitioner/Judgment Debtor.

When the revision petitioner did not pay the decreetal amount, he was ordered to be sent to Civil Prison for a period of three (3) months on payment of conveyance allowance and other execution charges by the respondent/Decree Holder. The order passed by the Court below is in consonance with Order XXI Rules 37 to 40 of CPC. No illegality has been committed by the Court below. Therefore, the Civil Revision Petition is devoid of merit and is liable to be dismissed. 4) Accordingly, this civil revision petition is dismissed at the admission stage. Miscellaneous petitions pending if any, shall stand closed. No order as to costs.
