THE HON'BLE Dr . JUSTI CE SHAMEEM AKTHER CI VI L REVI SI ON PETI TI ON No.1 9 9 1 OF 2 0 1 9 ORDER:

This revision, under Article 227 of the Constitution of India, is filed by the petitioner/ respondent aggrieved by the order dated 22.01.2019 passed in I.A.No.1255 of 2018 in O.P.No.1438 of 2017 by the Principal Judge, Family Court-cum-Additional Chief Judge, City Civil Court, Hyderabad, wherein respondent-wife and her children were granted interim maintenance of Rs.9,000/ - per month. 2.

Heard the learned counsel for the revision petitioner and perused the record.

3.

Learned counsel for the revision petitioner would contend that the amount granted to the respondent towards interim maintenance is excessive. The revision petitioner is an auto driver and he has no capacity to pay the said amount and ultimately prayed to set aside the impugned order.

4.

It is pertinent to state that now-a-days, the cost of living is very high. The rents of the houses are also high. More expenses are being incurred to pursue any education. Hence, granting of interim maintenance as indicated above is not excessive. There is no infirmity in the impugned order. The Court below is justified in granting the said amount. Under these circumstances, the Civil Revision Petition is devoid of merit and is liable to be dismissed.

5. In the result, the Civil Revision Petition is dismissed at the admission stage. No order as to costs.

The Miscellaneous Petitions, if any, pending shall stand closed. _______________________ Dr . SHAMEEM AKTHER, J Date: 16.09.2019 ssp
