HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No. 8565 OF 2012 ORDER:

This Writ Petition filed under Article 226 of the Constitution of India challenges the alleged inaction on the part of respondent Nos.1 to 4 in taking action on the representation, dated 19.03.2012, said to have been submitted by the petitioners. Heard learned counsel for the petitioners and the respondents. According to the petitioners, they made a representation to the 1st respondent, Gram Panchayat, requesting to prevent the unofficial respondents from encroaching upon and raising illegal construction on the public drain-cum-stream covered by Sy.No.109 of Korisapadu Village in between their site covered by Sy.No.110 and Ravinuthala road. With the above background, the present Writ Petition came to be filed on 24.03.2012. No counter affidavit has been filed by the respondents so far.

Therefore, this Court deems it appropriate to dispose of the Writ Petition basing on the material available. The filing of the representation on 19.03.2012 before the 1st respondent, Gram Panchayat, is not disputed by the respondents. Therefore, this Court deems it appropriate to direct the official respondents to take appropriate action on the representation, dated 19.03.2012, by fixing some time frame.

For the aforesaid reasons, the Writ Petition is disposed of, directing the official respondents to take appropriate action on the representation, dated 19.03.2012, said to have been submitted by the petitioners in accordance with law, after giving notice to all the stakeholders. This exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
