Heard Sri Giri Babu Marthi, for petitioners and the learned Assistant Government Pleader for respondents 1 to 4.

2. The petitioners complain against inaction of 2nd respondent in conducting survey to an extent of Ac.5.14 cents in Sy. No.184/ 6 (old Sy.No.8P) of Chippada village, Bheemunipatnam Mandal, Visakhapatnam District on the application made on 01.06.2017 and to direct respondents 3 and 4 to issue pattadar passbooks in favour of the petitioners, as illegal and arbitrary.

3. The Petitioners made a representation to the 2nd respondent on 01.06.2017 requesting to conduct survey and to direct the respondents 3 and 4 to issue pattadar pass books in their favour. The writ petition is filed on 13.06.2017. In the circumstances this court has difficulty to accept that there is delay or inaction on the application filed by the petitioners. The petitioners ought to give some reasonable and breathing time to the respondents to act in this matter. At this stage, the inaction complained is not made out. However, an opportunity is given to the petitioners to demand for compliance of survey and this court is of the view that 2nd respondent does the needful.

4. With the observation, the writ petition is dismissed. No order as to costs. Pending miscellaneous petitions if any in this writ petition shall stand dismissed in consequence.
