Heard learned counsel for the petitioner and learned Standing Counsel for respondent No.2.

The case of the petitioner is that respondent No.2 has taken the land in Survey No.400 of Nandyal Town, Kurnool District, on lease from its owner, by name, V. Diwakar, and is running a retail outlet therein. Respondent No.2 engaged the services of the petitioner as a labour contractor for assisting its officials in performing various jobs pending appointment of a regular dealer in the said outlet and entered into an agreement on 12.02.2004. The petitioner submitted bank guarantee for Rs.15,00,000/- and even after expiry of the agreement, the petitioner is being continued. While so, when respondent No.2 issued a publication on 01.03.2017 for engagement of service provider for the said outlet, the petitioner filed the present writ petition on the ground that no notice was issued to him before such publication.

As stated above, respondent No.2 engaged the services of petitioner as labour contractor for assisting its officials in performing various jobs in running the retail outlet. The agreement between the petitioner and respondent No.2 had already expired and the petitioner is being continued as a labour contractor as on today. Now, respondent No.2 wants to appoint a regular service provider for which a publication was issued on 01.03.2017. The publication

does not prevent the petitioner from applying for appointment as the service provider. Therefore, this Court sees no ground to interfere with the publication issued by respondent No.2 on 01.03.2017. The writ petition is accordingly dismissed.
