HONOURABLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION NO. 41294 OF 2015 O R D E R :

This writ petition is filed by the petitioner to declare the action of the third respondent in interfering with the civil litigation in respect of suit schedule property bearing Survey No. 274 in Plot Nos. 23 and 24 to an extent of 469 sq.yards in O.S.No. 151 of 2015 on the file of the Court of Junior Civil Judge, Nagarkurnol, as illegal, arbitrary, unconstitutional and void and consequently to direct the third respondent not to involve into the said civil litigation much less in support of the fourth respondent and to pass such other suitable orders.

2. Heard the learned counsel for the petitioner and the learned Government Pleader for Home [TG}.

3. The grievance of the petitioner is that the third respondent is interfering in civil dispute with regard to the suit schedule property bearing survey Nos. 274, Plot Nos. 23 and 24 in an extent of 469 sq.yards, which is the subject matter of O.S.No. 151 of 2015 on the file of the Court of Junior Civil Judge, Nagarkurnool, Mahboobnagar district.

4. The Assistant Government Pleader for Home submits on the strength of written instructions dated 04-1-2016 and also the counter-affidavit submits that the Police officials are not interfering

in civil dispute and more over the Police officials have not received any complaint from the petitioner in this regard.

5. Recording the same, the writ petition is dismissed. No costs. However, it is made clear that the respondent-officials shall not interfere and take undue advantage of their hierarchy to interfere in the civil dispute.

6. With the above observation, the writ petition is dismissed. No costs.

7. As a sequel, miscellaneous petitions if any pending in this writ petition shall stand closed.
