HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.30061 OF 2017 ORDER:

The writ petition is filed seeking to declare the action of the respondents 3 and 4 in calling the petitioner to the police station in a civil dispute pending before the civil court, at the instance of the 5th respondent as illegal.

Today, when the matter has come up for hearing, learned Government Pleader for Home passed on the written instructions given by the Sub Inspector of Police, V.Kota Police Station, Chittoor District stating that a case in Crime No.115 of 2017 under Sections 188 and 448 IPC was registered on the file of V. Kota Police Station and the investigation of the case is in progress. It is also stated that during the course of investigation on 26.12.2017, the Sub Inspector of Police, V.Kota Police Station called the petitioner to serve a copy of the notice under Section 91 Cr.P.C.

Learned Government Pleader for Home also passed on a letter addressed to him by the Sub Inspector of Police, Ramakuppam Police Station, Chittoor District stating that the petitioner was not called to police station for enquiry or for any other purpose and no case as such was registered in Ramakuppam police station.

Basing on the written instructions of the Sub Inspector of Police, V. Kota Police Station and the letter addressed to the Government Pleader for Home by the Sub Inspector of Police, Ramakuppam Police Station, no further orders are required to be passed in the matter.

Accordingly, the writ petition is closed. No order as to costs.

Miscellaneous Petitions, if any pending in this writ petition shall also stand closed.
