THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.12396 of 2013 ORDER:
Petitioner prays for the following relief :- " ..... to issue a writ, order or direction more particularly one in the nature of mandamus declaring the inaction of the 2nd respondent in investigating the FIR No. 178/ 2008, which was registered basing on the complaint dated 17.11.2008, as illegal, arbitrary, and violation of the provisions of the Code of Criminal Procedure and consequently direct the respondents to conduct proper investigation and determine/ trace out the gold jewellery of the petitioner and hand over the same to her ...."
The Assistant Government Pleader, basing on written instructions, dated 16-05-2013 and the final report filed before the Judicial Magistrate of First Class, Sullurupeta, submits that the case is closed as 'undetectable' and the case can be reopened whenever there are clues.
Counsel for petitioner submits that the copy of final report is not served on the petitioner.
The Assistant Government Pleader firstly relies upon refusal to receive final report recorded in the instructions and secondly to give quietus to this objection, hands over copy of final report to counsel for petitioner.
Counsel for petitioner acknowledges the same.
As noted in the final report, the petitioner, if advised, can give further information to police or pursue legal remedies. With the above observation, the writ petition is disposed of accordingly. No order as to costs.
