HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35348 of 2016 ORDER:

This writ petition is filed by the petitioners under Article 226 of the Constitution of India seeking a direction to the 3rd respondent not to interfere with the peaceful possession and enjoyment of the petitioners over the property bearing Door No.6-2-46/47, Christian Peta, Sathenapalli Town & Mandal, Guntur District, and also not to interfere with the civil disputes in respect of the property of the petitioners. 2.
Heard and perused the material available on record. 3.
The grievance of the petitioners is that the 5th respondent filed a false case before the 4th respondent proclaiming that he is the owner of the property and on the advice of the 4th respondent, the 3rd respondent is summoning the petitioners and directing them to come every day to the police station and that the 3rd respondent and their subordinates are regularly interrupting the petitioners and they are trying to dispossess the petitioners from their property at the instance of the 5th respondent. 4.
Considering facts and circumstances of the case and the grievance of the petitioners, without expressing any opinion on merits, the Writ Petition is disposed of with the following direction:
Respondent No.3 is directed not to interfere with the possession and enjoyment of the petitioners over the aforesaid property and with any of the civil disputes in respect of the property of the petitioners. At the same time, this order will not stand in the way of respondent No.3 to proceed with the
investigation, if any case is registered against the petitioners for cognizable offence.
