15-02-2022 LK, J I.A.No.1 of 2022 This petition is filed seeking relaxation of the condition imposed by this Court by order dated 26.04.2021 in I.A.No.2 of 2021 in Crl.P.No.6135 of 2020, whereby the petitioner/A8 was directed to appear before the Station House Officer, Madhapur (Guttala) Police Station on 3rd Sunday of every month between 10.00 am and 2.00 pm till submission of the charge sheet/final report.

Initially, this Court, by order dated 10.12.2020 in Crl.P.No.6135 of 2020, while granting pre-arrest bail to the petitioner, has directed him to appear before the police on every Sunday between 10.00 am and 5.00 pm, till completion of investigation and filing of charge sheet. The said condition was modified by this Court by order dated 09.02.2021 in I.A.No.1 of 2021, directing the petitioner to report before the police concerned on 1st and 3rd Sunday of every month between 9.00 am and 11.00 am. Thereafter, this Court, by order dated 26.04.2021 in I.A.No.2 of 2021, modified the said condition directing the petitioner to appear before police concerned on 3rd Sunday of every month between 10.00 am and 2.00 pm till filing of the charge sheet/final report.

Learned counsel for the petitioner Mr. C. Vikram Chandra, submits that the petitioner has been complying with the said condition and in view of his occupation, it is very difficult for him to comply with the said condition.

Learned Assistant Public Prosecutor does not dispute the fact that the petitioner is complying with the condition and he submits that the investigation is still pending.

Taking into consideration the fact that the petitioner is appearing before the police concerned from the last more than 11⁄2 years, this Court deems it appropriate to relax the said condition. However, as the investigation is pending, if the presence of the petitioner is required for the purpose of investigation, the police concerned shall issue notice to him, and on receipt of such notice, he shall appear before the police.

Accordingly, I.A., is ordered.
