THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.23321 OF 2017 ORDER:

The writ petition is filed questioning the action of the official respondents in not providing the Police Protection to the lives and properties of the petitioner and their men, while they were carrying out their construction and internal work and day to day prayer from the regular and illegal attacks of unofficial respondents 7 to 12 and their henchmen.

Notice before admission was ordered. Today, when the matter is taken up for hearing, learned Government Pleader for Home has placed on record the written instructions received from the Sub Inspecotor of Police, Banjara Hills Police Station, Hyderabad, which reads as under: "I humbly submit that action was taken on the complaints of the petitioner herein by registering the cases and investigated into. Both the groups are claiming rights and tile over the subject Masjid in question. Under these circumstances, police protection cannot be provided except registration of cases and proceeding with the cases as per law whenever any cognizance offence taken place."

In the light of the above, the writ petition is disposed of leaving it open for the petitioner to take appropriate legal proceedings including approaching the Civil Court to protect his rights if any. Miscellaneous Petitions, if any pending in this writ petition, shall also stand closed. No order as to costs.
