THE HONOURABLE SRI JUSTICE M. LAXMAN CRIMINAL PETITION No.6421 OF 2023 ORDER:

This petition is filed under Sections 437 and 439 of Criminal Procedure Code, 1973 (Cr.P.C) seeking to grant regular bail to the petitioner who is arrayed as accused in CC No.1022 of 2017 on the file of the VII Additional Chief Metropolitan Magistrate, Hyderabad. The offences alleged against the petitioner are under Sections 407, 420 and 506 of the Indian Penal Code.

Learned counsel for the petitioner-accused stated that while the trial is pending, the petitioner was absent to the Court proceedings, as such, the Court below has issued nonbailable warrants on 21.06.2023 and in execution of warrants; the petitioner-accused was remanded to judicial custody on 05.07.2023. The reasons given for the absence was on account of his ill health and demise of one of his relatives. 3.
Heard learned Additional Public Prosecutor for the respondent - State.

Considering the nature of offences, which he is facing and the remand period, the petitioner can be granted bail. 5.
Accordingly, the Criminal Petition is allowed and the petitioner-accused shall be released on bail on the following terms and conditions:
(i) The petitioner-accused shall be released on bail on his executing a personal bond for Rs.10,000/- (Rupees Ten thousand only) with one surety for a like sum to the satisfaction of the VII Additional Chief Metropolitan Magistrate at Hyderabad.
(ii) The petitioner-accused shall promptly attend the proceedings of the Court without obstructing the trial proceedings.
