HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 5118 of 2019 ORDER :

The petitioner, who is the sole accused, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.78 of 2019 of Yellareddy Police Station, registered for an offence punishable under Section 306 IPC. 2.

The allegation leveled against the petitioner is that she used to quarrel with her mother-in-law Devavva (deceased) regarding their debts and on 15.05.2019 both of them quarreled and later the petitioner went to her parental house. On 17.05.2019, the deceased and her son, attended the function at Nagireddypet Village, where the petitioner abused the deceased in filthy language and told that she will not come to their house, due to which the deceased got frustrated and on the same day she committed suicide by consuming poison.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor.

It has been submitted by the learned counsel for the petitioner that the petitioner has been falsely implicated in this case and she has no way connected with the alleged offence. It is further submitted that the petitioner is permanent resident of Rampur Village, she is ready to abide by the conditions imposed by the Court. It is also stated that entire investigation is completed, except filing of formal charge sheet.

As seen from the contents of the First Information Report, there are specific allegations against the petitioner and the petitioner used to quarrel with the deceased with regard to the debts. On 17.05.2019 also the petitioner abused the deceased in filthy language and made an attempt to assault the deceased, due to which the deceased had vexed with her life and committed suicide by consuming poison on the same day at 8.00 p.m. While undergoing treatment, she succumbed. Looking into the nature of allegations; gravity of the offence and involvement of the petitioner, I am not inclined to grant bail to the petitioner.
