HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No. 17425 of 2002 ORDER:

This writ petition is filed seeking to issue a writ of mandamus declaring the action of the 2nd respondent in not initiating action to enforce the orders of the appellate authority in B & C appeal No.3 of 1983 with file No.B/7560/83 dated 28.12.1988 under Section 31 (2) r/w Sections 33, 34 and 36 of the Beedi & Cigar Workers (COE) Act, 1966, as illegal and arbitrary. A consequential direction is also sought to give effect to the orders of the 1st respondent appellate authority dated 28.12.1988 for reinstating the petitioner into service with continuity of service, back wages and all consequential benefits including arrears of salary.

Heard Sri S. Rahul Reddy, learned counsel for the petitioner, and Sri M. Surender Rao, learned counsel for the 2nd respondent. The grievance of the petitioner is that the orders of the 1st respondent appellate authority are not complied with so far. It is brought to the notice of the Court that while admitting the writ petition, this Court directed the 2nd respondent to give effect to the orders of the 1st respondent appellate authority dated 28.12.1988 vide orders dated 12.09.2002 in WPMP No.21854 of 2002 and by way of the interim order dated 12.09.2002, the relief sought for in the writ petition was already granted in favour of the petitioner.

Having considered the submissions made by the learned counsel on either side and perused the record, this Court is of the view that the interim orders dated 12.09.2002 passed by this Court in WPMP No.21854 of 2002, if not complied with so far, shall be complied with by the respondents, within a period of four (4) weeks from the date of receipt of a copy of this order. With the above observation, the writ petition is disposed of. Consequently, miscellaneous petitions, if any, pending in the writ petition shall stand closed.
