THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44901 OF 2016 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to declare the inaction of the 3rd respondent in providing police protection to the petitioners in spite of subsisting injunction orders in favour of the petitioners passed in I.A.No.1559 of 2009 in O.S.No.1262 of 2009, dated 14.07.2009 by the VIII Additional Senior Civil Judge, Ranga Reddy District, in respect of Plot bearing Nos.89 to 93 admeasuring 3663.5 square yards situated at Hafeezpet Village, Seri Lingampally Mandal and Municipality, Ranga Reddy District, in spite of registering a crime vide Crime No.92 of 2013, dated 22.02.2013 of Station House Officer, Miyapur Police Station, Cyberabad, Ranga Reddy District3rd respondent, as arbitrary and illegal. 2.

Heard and perused the material available on record. 3.

Case of the petitioners is that they are absolute owners and possessors of the aforesaid plots having purchased the same under a registered sale deed. The unofficial respondents, who are not having any right, title or interest over the property, are trying to interfere with peaceful possession and enjoyment of the petitioners over the subject property. After exhausting all remedies, the petitioners filed O.S.No.1262 of 2009 on the file of VIII Additional Senior Civil Judge, Ranga Reddy District 4.

Learned counsel for the petitioners submits that the petitioners are owners and possessor of aforesaid plots; that the

unofficial respondents, who have no right, title or interest over the property, are trying to interfere with the same. 5.

Considering all the facts and circumstances of the case and submissions of learned counsel for the petitioners, the respondentpolice are directed to proceed with the investigation and if the petitioners inform the official respondents apprehending danger in the hands of the unofficial respondents, the official respondents are directed to take appropriate steps to protect the rights of the petitioners herein.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
