HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION Nos.16582 AND 17132 OF 2009 COMMON ORDER:

Since the subject matter in both the writ petitions arose out of the same proceedings, both the writ petitions are being disposed of by this common order.

W.P. No.16582 of 2009 is filed to direct the respondents to refund the performance security deposit amount of Rs.2,00,000/ - to the petitioner as per the agreement No.C/ 934/ 07, dated 21.06.2008, by declaring the impugned order in proceedings No.C/ 934/ 07, dated 22.07.2009, as illegal and arbitrary, and consequently, set aside the same.

W.P. No.17132 of 2009 is filed to direct the respondents to refund the performance security deposit amount of Rs.3,40,000/ - to the petitioner Society by declaring the impugned order in proceedings No.C/ 934/ 07, dated 22.07.2009, as illegal and arbitrary, and consequently, set aside the same.

Heard and perused the material available on record. After arguing for some time, learned counsel for the petitioners in both the writ petitions submitted that the petitioners may be permitted to make representations informing their respective grievance to the respondents and, prayed this Court to direct the respondents to consider the said representations in accordance with law. Considering the said submission of the learned counsel for the petitioners, this Court is inclined to pass the following order:

" The petitioners are directed to submit representations before the officials concerned, regarding their grievance within a period of thirty (30) days from the date of receipt of a copy of this order and on such representations being filed, the officials concerned are directed to consider the same and pass appropriate orders in accordance with law." With the above directions, both the writ petitions are disposed of. No order as to costs. Consequently, miscellaneous petitions pending, if any, shall stand closed.
