THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.4931 OF 2016 ORDER:

This petition is filed by the petitioners-accused Nos.1 and 2 under Section 482 Cr.P.C. seeking to quash the docket order dated 28.1.2016 passed in C.C.No.87 of 2016 by the VII Additional Metropolitan Magistrate, City Criminal Courts, Hyderabad. Heard and perused the material available on record. The learned Magistrate while taking cognizance of the offences punishable under Sections 326, 448, 506(1) and 427 IPC against the petitioners and other two accused, issued NBWs against the petitioners herein vide the order impugned herein. Aggrieved by the same, the petitioners approached this Court.

Considering the facts and circumstances of the case, this Court is inclined to pass the following order:

"The petitioners-A1 and A2 are directed to surrender before the trial Court and move an application seeking to recall NBWs issued against them. On such surrender and on such application being filed, the trial Court is directed to recall NBWs issued against the petitioners on the same day and release them on bail on each of them executing a personal bond for a sum of Rs.5,000/- (Rupees Five Thousand only) with one surety for the like sum each to the satisfaction of the trial Court. The petitioners are directed to appear before the trial Court on all hearing dates." Accordingly, the Criminal Petition is disposed of.
