Heard Sri D.Krishna Murthy for petitioners and the Assistant Government Pleader (Land Acquisition).
The grievance of petitioners is that the representations dated 07-11-2016 and 08-11-2016 filed by their vendor M&M Infracon Projects (India) Private Limited, are not considered and disposed of by respondents 2 to 4 and still the respondents are proceeding with the proposed development plan of 5th respondent. I have perused the representations and I am of the view particularly having regard to the registered documents through which the petitioners claim, right and title to independent plots purchased from M&M Infracon Projects (India) Private Limited, that the said representations are treated as representations filed by petitioners, the grievances are considered and a decision is taken and communicated to petitioners as well.
The inaction on one hand and simultaneous execution of project as rightly pointed out by Sri Krishna Murthy is voilative of Article 300-A of the Constitution of India.
Having regard to the above circumstances and after perusing the written instructions dated 08-12-2016, I am satisfied the writ petition can be disposed of by this order.
The petitioners are given liberty to re-submit representations, referred to above, by enclosing a copy of this order to respondents 2 to 4 within ten days from today. Respondents 2 to 4 are directed to consider the grievance of petitioners, take a decision within four weeks thereafter and communicate the decision to petitioners. If the petitioners are aggrieved by the communication, liberty to assail the communication is granted.
The writ petition is disposed of accordingly. No order as to costs.
