HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.15607 OF 2018 O R D E R :

This petition is filed for a writ of Mandamus declaring the action of the 3rd respondent in interfering with the personal liberty of the petitioner by making him to sit hours together in the police station or calling on his mobile and abusing him even without there being any crime registered against him, only on the basis of the complaint of his wife even though the counselling failed for re-union, as illegal and arbitrary.

Heard learned counsel for the petitioner.

Learned Assistant Government Pleader for Home produced written instructions stating that the respondent No.3 called the petitioner over phone only when complaint was given by his wife, and after that the 3rd respondent never called the petitioner to police station nor never called him on phone. It is also stated that petitioner's wife gave complaint against the petitioner on 02.02.2018 and in pursuance of the same, the 3rd respondent sent both the parties to the Legal Service Committee, Nandigama for counselling and since both the parties failed to compromise the matter a case was registered in Crime No.121/2018 for the offences under Sections 498-A, 506 IPC & Sec.3 & 4 of Dowry Prohibition Act of Nandigama P.S. Thereafter investigation is completed and

charge sheet was filed on 31-05-2018 before the A.J.F.C.M., Nandigama.

Recording the aforesaid submission of the learned Assistant Government Pleader for Home, the writ petition is disposed of. No order as to costs.
