HON'BLE SRI JUSTICE S.V.BHATT W.P.No.31830 OF 2011 ORDER:

Learned counsel after arguing the matter for some time and with a view to first approach the 2nd respondent, requests the Court to permit him to withdraw the writ petition with liberty to make representation to 2nd respondent and the 2nd respondent may be directed to consider the same.

I am not proposing to state the circumstances under which the petitioners could not open the stalls and do business as licencees for 27 days. The fact of the matter is, according to petitioners, there was complete standstill in activity and the respondents can be directed to consider the representation.

If the petitioners make representation within four weeks from the date of receipt of a copy of this order, having regard to special circumstances, the 2nd respondent is directed to consider and pass appropriate orders within two months thereafter. Till a decision is taken and communicated, the stay granted on 02.12.2011 shall be operative.
