HON'BLE DR. JUSTICE B. SIVA SANKARA RAO CIVIL REVISION PETITION No.5628 of 2015 ORDER:

Heard both sides and perused the grounds of revision and the impugned order of the lower Court.

The amendment is only formal even a personal decree asked unless it is satisfied with the requirement of Section 52(2) CPC. The question of personal decree against the LRs of the deceased of the property in their hands does not arise, but for to grant against the estate of the deceased. Thereby, this amendment is practically to proceed against the property in the hands of LRs of the deceased of the borrower that is the defendants.

Thus there is nothing to interfere. Accordingly and in the result, the Civil Revision Petition is disposed of. Consequently, miscellaneous petitions, if any shall stand closed. No costs.
