HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36290 of 2016 ORDER:

This writ petition is filed by the petitioner under Article 226 of the Constitution of India seeking to direct the respondents to complete the investigation and file charge sheet against the accused persons. 2.

Heard and perused the material available on record. 3.

The main grievance of the petitioner is that he is the owner of a residential building consisting of ground and first floor and he gave ground floor for rent to the 4th respondent about nine years ago and the petitioner is residing in the first floor. The petitioner has been requesting the 4th respondent to vacate the said premises as he wants the same for his personal occupation. But the 4th respondent refused to vacate. On 12.9.2016, when the petitioner requested respondents Nos.4 to 6 to vacate and hand over the ground floor, the said respondents abused him, beat him with chappals and threatened him. Then, the petitioner gave a complaint against respondents Nos.4 to 6 and on the said complaint the 3rd respondent registered a crime in FIR No.193 of 2016. But he has not taken any action so far.

Considering the facts and circumstances of the case and the grievance of the petitioner, without expressing any opinion on merits, the Writ Petition is disposed of with the following directions: "The official respondents are directed to complete the investigation and file a final report in the above Crime in either way, in accordance with law, as expeditiously as possible."

There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
