THE HON'BLE SRI JUSTICE M.GANGA RAO WRIT PETITION No.16086 OF 2007 ORDER:

This writ petition is filed by the petitioner-Grameena Vikas Bank seeking a direction to the respondents not to disburse the compensation amount to the land owners on the ground that they have obtained loans from the bank keeping the lands as a security created on the crops under hypothecation deeds and if the compensation is paid to them without conducting any enquiry into the claims furnished by the petitioner-bank, it is difficult for it to recover the amounts from the borrowers.

This Court, while admitting the writ petition on 30.07.2007, passed an interim order, directing the third respondent not to disburse the compensation amount to the borrowers of the petitioner-bank, without considering the claim petition submitted by the petitioner-bank in pursuance to the notification under Section 4(1) of the Land Acquisition Act, 1894 and Section 6 Declaration.

Now, it is represented by the learned counsel for the petitioner that loans were recovered from the borrowers and no-objection certificates were issued for the amounts of which compensation is being paid to the borrowers, and hence, no further orders are required in this writ petition.

Recording the said submission of the learned counsel for the petitioner, the writ petition is closed. No costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
