WRIT PETITION NO.15725 OF 2018 ORDER :

According to petitioner, he purchased the property through registered document bearing No.10081/2016 dated 28.04.2016.

According to petitioner, schedule mentioned in the registered document is mismatching with the plan paper in the registered document and also the schedule and plan papers were subsequent documents. Having faced with this difficulty, this writ petition is filed praying to declare the action of 3rd respondent in not rectifying the errors in the schedule and sale deed bearing no.12628/1986 dated 21.10.1986 in the registration records as illegal, arbitrary and unconstitutional and seeks consequential directions.

Apparently, no application is filed before the registering authority. Be that as it may, according to petitioner there are mistakes in the schedule describing the property. If there are mistakes in the schedule describing the property, petitioner has to avail appropriate remedy as available in law. He cannot file writ petition directly under Article 226 of the Constitution of India to seek correction of entries in the registration records or seek direction to registering authority to undertake such job. Therefore, prayer sought in the writ petition cannot be granted. Writ Petition is dismissed, leaving it open to petitioner to work out his remedy as available in law.

Pending miscellaneous petitions shall stand closed. There shall be no order as to costs.
