THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7512 of 2011 ORDER:

This writ petition is filed challenging the action of the respondents in trying to excavate the canal in petitioner's land situated in Sy.No.1174, South Addanki, Addanki Mandal, Prakasam District, without issuing any notice or without following the due process of law.

Heard both sides.

This Court on 23.03.2011 while admitting the writ petition, granted an interim direction as prayed for.

Learned Government Pleader for Revenue (A.P), placed on record the proceedings dated 16.11.2015, issued by the 2nd respondent-Tahsildar, stating that there was no proposal of digging any canal through the petitioner's land and as a matter of fact the canal work had already been completed. Having regard to the facts and circumstances of the case and especially in view of the proceedings dated 16.11.2015, issued by the 2nd respondent-Tahsildar, nothing survives in the writ petition and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed as infructuous. No order as to costs.
