HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Writ Petition No.4004 of 2012 ORDER:

The petitioners seek a writ of Mandamus declaring the action of the 3rd respondent in registering Cr.No.3 of 2012 of Maddur PS, Mahabubnagar District as illegal and arbitrary and to quash the proceedings.

2) This Court on 15.02.2012 passed an order that the respondents may proceed with the investigation in Cr.No.3 of 2012 of PS Maddur, Mahabubnagar District but, however, shall not arrest the petitioners pending further orders and the said order is being continued. 3) At the time of hearing, learned Government Pleader for Home, on instructions, would submit that in this case investigation was completed and charge sheet was filed and the same was taken cognizance by the Judicial First Class Magistrate, Kodangal and registered as C.C.No.145 of 2013 and the same is posted for trial to 07.09.2018. 4) In view of present stage of the case, this Writ Petition is closed giving liberty to the petitioners to face trial and vindicate their defence before the trial Court. The order dated 15.02.2012 that the petitioners shall not be arrested shall hold good till completion of trial. No costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
