HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.18008 OF 2019 ORDER:
This writ petition is being disposed of at the admission stage with the consent of both parties.
This writ petition is filed seeking a Writ of Mandamus declaring the order of suspension dated 24.04.2019 issued by the 3rd respondent as illegal, arbitrary and contrary to the Rules and sought a consequential direction to direct the respondents to reinstate the petitioner into service as Community Organiser of Municipal Corporation, Nizamabad.
Heard Sri M. Srikanth, counsel for the petitioner, and Sri N. Ramu, Standing Counsel appearing for the 2nd and 3rd respondents.
It has been contended by the petitioner that he is working as Community Organizer with the 3rd respondent Municipal Corporation and while he was discharging his duties, the respondents have placed him under suspension vide proceedings dated 24.04.2019 on the allegation that he was unauthorisedly absent for one day. The grievance of the petitioner is that against the suspension orders, he has submitted representation to the respondents on 25.04.2019 requesting the respondents to reinstate him into service, by duly enclosing medical certificate. The petitioner also contended that owing to illhealth, he could not attend to duty for one day, and the respondents
are not reviewing the suspension orders even though more than six months elapsed.
Therefore, counsel for the petitioner contended that appropriate orders be passed in the writ petition directing the respondents to review the suspension orders dated 24.04.2019 in accordance with law.
Standing Counsel appearing for the respondents had contended that the case of the petitioner would be reviewed strictly in terms of G.O.Ms.No.86 dated 08.03.1994 and appropriate orders will be passed in accordance with law.
This Court, having considered the submissions of learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to review the suspension orders dated 24.04.2019 strictly in terms of G.O.Ms.No.86 dated 08.03.1994 and pass appropriate orders in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
With the above directions, the writ petition is disposed of. No order as to costs.
