THE HON'BLE SRI JUSTICE S.RAVI KUMAR Tr.C.M.P.No.820 of 2015 ORDER:

This application is filed to withdraw F.C.O.P. (H.M.O.P) No.428 of 2015 from Family Court, Guntur and transfer the same to the Family Court, Hyderabad or Secunderabad.

2. Petitioner herein is wife of the respondent herein. She filed the present application stating that her husband is residing at Ramachandrapuram, Medak and working at IDA Bollaram, Ranga Reddy District for the last two years. She further stated her husband filed divorce petition with false and untenable allegations. She is working in a private establishment at Hyderabad and looking after her two children and it is difficult for her to defend H.M.O.P.No.428 of 2015 by traveling from Hyderabad to Guntur. She further stated that Family Court, Hyderabad or Secunderabad is convenient for both parties. For these reasons, she prayed for transfer of H.M.O.P.No.428 of 2015 from Family Court, Guntur to Family Court, Hyderabad or Secunderabad.

This Court permitted the petitioner to take personal notice to the respondent by registered post with acknowledgment due and in compliance of the said order notice was taken to the respondent to his both addresses i.e., Hyderabad address and Guntur address. The advocate for the petitioner filed a Memo stating that notices are served on the respondent at both addresses and filed postal acknowledgment and track report of postal department.

4. In spite of service of notice, respondent neither appeared in person nor through any Advocate.

5. Heard arguments.

Considering the reasons stated in the affidavit filed in support of the petition and also considering the fact that both wife and husband are working at Hyderabad, it would be convenient for both of them if H.M.O.P.No.428 of 2015 is transferred to Family Court, Hyderabad. Therefore, F.C.O.P (H.M.O.P) No.428 of 2015 is withdrawn from Family Court, Guntur and transfer to Family Court, Hyderabad for disposal in accordance with law.
