THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.43410 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India seeking a writ of Mandamus declaring the inaction of the 4th respondent in considering the representation of the petitioner dated 07.11.2016 for payment of compensation to the petitioners in respect of the land acquired by the Government to an extent of Ac.2.18 guntas in S.No.42 of Rudramakota Revenue village, Velerpadu Mandal of West Godavari District as illegal and arbitrary. Heard the learned counsel for the petitioner, learned Government Pleader for Land Acquisition (A.P), learned Government Pleader for Revenue (A.P.), learned Government Pleader for Irrigation and CAD (A.P) and Sri K.Jyothi Prasad learned counsel for the 5th respondent.

It is the case of the petitioners that they own an extent of Ac.2.18 guntas of land in S.No.42 of Rudramakota Revenue village, Velerpadu Mandal of West Godavari District. The Government acquired the land of the petitioners but failed to pay compensation. In this regard, the petitioner submitted a representation to the 4th respondent on 07.11.2016. For one reason or the other, the said representation was not disposed of so far.

The only relief sought by the learned counsel for the petitioner is to direct the 4th respondent to dispose of the representation dated 07.11.2016 submitted by the petitioners as expeditiously as possible.

In view of the submission made by the learned counsel for the petitioner, this Court is not expressing any opinion touching the merits of the main case.

Having regard to the submission made by the learned counsel for the petitioner, the 4th respondent is hereby directed to dispose of the representation dated 07.11.2016 submitted by the petitioner in accordance with law, as expeditiously as possible, preferably, within a period of one month from the date of receipt of a copy of this order. Accordingly this Writ Petition is disposed of. No order as to costs. As a sequel, miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
