THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.22678 of 2015 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue Writ of Mandamus declaring the action of respondent No.3/Ramgopalpet P.S. in insisting the petitioner to come to the police station without there being any crime registered, only at the instance of respondent Nos.4 and 5, who is highly influential, as illegal and arbitrary". Heard Sri N.Ravi Prasad, learned counsel for the petitioner and learned Government Pleader for Home for respondents 1 to 3. When the matter is taken up today, written instructions dated 27.07.2015 furnished by the Inspector of Police, Ramagopalpet Police Station, Hyderabad City have been placed on record by the learned Government Pleader for Home appearing for respondents 1 to 3.

In the said written instructions, it is stated as follows :- "It is respectfully submitted that as per the records, it is revealed that, as of now, no complaint or case whatsoever is received or registered against the petitioner herein on the file of Ramagopalpet Police Station, Hyderabad City. It is respectfully submitted that the petitioner herein is not at all required in connection with any cases registered on the file of Ramagopalpet Police Station. It is respectfully submitted that the allegation of the petitioner the respondent Nos.4 and 5 took him to this respondent police station for signing in some agreement papers in front of the police personnel using filthy language and also manhandled in the police station is absolutely false, baseless and hence denied. The allegation of the petitioner that this respondent is also supporting the respondent Nos.4 and 5 herein and fixing deadlines for payment of dues orelse, he would be eliminated, in case he failed to repay the dues is utterly false and hence denied.

It is humbly submit that it appeared that the dispute of the petitioner as well as the unofficial respondents herein is purely civil in nature and this respondent police has no way concerned with it.

It is pertinent to submit that as a precautionary measure to prevent the police from taking any action in the event of lodging of any complaint, the petitioners filed the present writ petition.

I humbly submit that having bore grudge against the unofficial respondents herein, the petitioner made baseless allegations against this respondent. I humbly submit that at no point of time, this respondent summoned the petitioners herein nor asked them to compromise the matter nor interfered with their life and liberty." On noticing the said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and close the writ petition. In view of the above, the Writ Petition is closed by recording the instructions as mentioned supra. No costs.
