HON'BLE SRI JUSTI CE V. RAMASUBRAMANI AN HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI WRI T PETI TI ON No.29577 of 2017 ORDER: (Per VRS,J) The petitioner came up with the above writ petition, challenging a notification issued by the 2nd respondent for the third round, known as Mop-Up round of counseling.
2. Heard Mr. D. Madhava Rao, learned counsel for the petitioner and Mr. A. Prabhakar Rao, learned counsel for the 2nd respondent.
3. By the impugned notification the 2nd respondent restricted entry of those who had already secured admissions in the first, second and third phase of counseling to MBBS course. Contending that the candidates have a right to jump from one college to a better college, the petitioner came up with the above writ petition.
4. On 31.08.2017 an interim order was passed to the following effect.
"Prima facie, we are of the opinion that the condition imposed in the notification dated 28.08.2017, for exercising web options for mop-up counseling, to the effect that candidates who secured admission and joined in the second and third phases of cousnelling in M.B.B.S course would not be allowed to exercise their options, is unfair and arbitrary. Thereby, candidates with better ranks are excluded from the counseling and cannot opt for better colleges of their choice and such vacant seats are allotted to candidates with lesser merit. We are informed that seats are still available in Osmania and Gandhi Medical Colleges in M.B.B.S course. If that is so, the petitioner shall be considered for allotment of a vacant seat in either of these colleges in accordance with merit.
Sri A. Prabhakar Rao, learned Standing Counsel for the second respondent, shall intimate the authorities concerned of this order over the telephone due to want of time.
5. Today, it is submitted by the learned counsel for the petitioner that despite the interim order, the petitioner could not secure admission to a better college than the college to which she was already allotted.
Now that the deadline for admission is over, nothing further remains in this writ petition, for adjudication. Hence the writ petition is closed.
6. As a sequel, miscellaneous petitions pending in this writ petition, if any, shall stand closed. There shall be no order as to costs. ______________________ V. RAMASUBRAMANI AN , J.
