HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.18021 of 2019 ORDER:

When the matter is taken up for hearing, learned counsel appearing for the respective parties submitted that the issue involved in this writ petition is squarely covered by the orders passed by this Court in W.P.No.7358 of 2012, dated 29.03.2012 wherein this Court permitted engagement of the petitioner therein as a fresh Driver forthwith.

In view of the above submission and for the reasons recorded therein, this writ petition is disposed of directing the respondents to re-engage the petitioner as a Driver on contract basis afresh. It is further made clear that the delay on the part of the petitioner in reporting to duty can be balanced by requiring the petitioner to forego his earlier service. There shall be no order as to costs. Pending miscellaneous applications, if any, shall stand closed.
