Khaja Moinuddin, v. The Project Officer And District T.B. Control Officer,
THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.23690 OF 2005 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue an order or direction more particularly, in the nature of writ of mandamus to declare the action of the respondents in issuing the impugned notification, dated 22.8.2005, and consequential proceedings No.66/RNTCP/DTCS-MDK/05, dated 27.9.2005, as illegal and arbitrary and consequently, to set aside the said notification and the proceedings and direct the petitioner to continue in service. 2.
The petitioner challenges the notification which was issued in the year 2005. Admittedly, the said notification was issued to select the candidates to the posts of Senior Treatment Supervisors (STS), Senior Tuberculosis Lab Supervisors (STLS) and Lab Technicians (LT) on contract basis only for a period of one year. Hence, this Court is of the view that nothing survives for adjudication in this writ petition and therefore, the Writ Petition is liable to be dismissed as infructuous.
3.
Accordingly, the Writ Petition is dismissed as infructuous. There shall be no order as to costs.
4.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
