HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.14328 OF 2005

ORDER

This writ petition is filed seeking the following relief: "...to call for the records from the 1st respondent and issue an appropriate writ, order or direction, particularly one in the nature of writ of Certiorari and quash the order passed by the 1st respondent in P.G.No.17 of 2004, dated 10.5.2005, directing to pay a sum of Rs.18,173/- as gratuity to the 2nd respondent as illegal, unjust, contrary to law and without jurisdiction; and grant all consequential benefits."

Heard Sri A.K.Jaya Prakash Rao, learned counsel appearing for the petitioner, and learned Government Pleader for Labour appearing for the 1st respondent.

The petitioner is the M/s.New Classic Kanchi Saree House. The 2nd respondent-workman has filed a claim petition before the 1st respondent seeking gratuity. The 1st respondent passed order on 10.05.2005 directing the petitioner to deposit a sum of Rs.18,173/- towards gratuity. Challenging the same, the present writ petition is filed. Learned counsel appearing for the petitioner contends that without appreciating any of the contentions raised by the petitioner, the 1st respondent directed the petitioner to deposit the said amount.

Having considered the facts and circumstances of the case, this Court is of the view that unless and until grave irregularity or illegality has been pointed out by the petitioner, this Court is not inclined to interfere with the reasoned order passed by the 1st respondent. There are no merits in the writ petition and the same is liable to be dismissed. Accordingly, the Writ Petition is dismissed. No costs. Miscellaneous petitions, if any, pending shall stand closed.
