HON'BLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.5104 OF 2018 ORDER:

Heard learned counsel for petitioner/A3 in crime No.35 of 2018 of Zaheerabad Police Station, Sangareddy District, registered for the offence punishable under Section 392 IPC and the learned Public Prosecutor appearing for the State and perused the FIR and the disclosure statements of A.1 and A.2 of the lorry seized from the disclosure made by A.1 with the possession of A.2 and the disclosure statements state that it is at the privy and the instance of the petitioner/A3, the prime accused.

It is the contention of the learned counsel for the petitioner that he is innocent and falsely implicated. The learned Public Prosecutor opposed the bail application. As very disclosure statements of A.1 & A2 disclose the privy and preconception of A3-petitioner though admissibility of confession of co-accused how far under Section 13 of the Indian Evidence Act is a matter for trial and it is premature, but for to say there is prima facie accusation, not a fit case to grant concession of anticipatory bail.

Hence, this Criminal Petition is dismissed.
