THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.15616 of 2018 ORDER:

The petitioner is aggrieved by the action of the Revenue Divisional Officer, Nakrekal Mandal, Nalgonda District, in deleting the name of his father, viz., Mohammed Ali Khan, from the revenue records in respect of the land admeasuring Acs.28.36 guntas in Survey Nos.202, 289, 291 and 292 of Nakrekal Mandal, Nalgonda District.

Perusal of the record reflects that even in the Adangal Pahani dated 14.06.2017 in relation to the land in Survey No.292/A, the name of the petitioner's father, Mohammed Ali Khan, is shown in the pattadar column but the names of two other individuals, viz., Yathakula Somaiah S/o Mysaiah and Yathakula Narasimha S/o Lingaiah, are shown in the possessors' column. It is an admitted fact that the same is the situation with the other survey numbers as I.A.No.2 of 2018 was filed by the petitioner seeking to implead as many as 31 persons as respondents in this writ petition on the ground that their names find mention in the revenue records as against the subject survey numbers. It may be noted that the Tahsildar, Nakrekal Mandal, Nalgonda District, vide Endorsement dated 03.01.

2018 already informed the petitioner that his remedy in relation to the entries made in the revenue records would be to prefer an appeal before the Revenue Divisional Officer, Nakrekal Mandal, Nalgonda District, under Section 5(5) of the Telangana Rights in Land and Pattadar Pass Books Act, 1971. There is no indication of the petitioner having taken any steps in that regard. As the petitioner is provided an effective alternative remedy of preferring an appeal under the statutory provision, this Court sees no grounds to entertain this writ petition.

of enquiry in this writ petition would be limited and this Court cannot undertake resolution of disputed questions of fact including those relating to who is in actual possession of the subject land. The writ petition is accordingly dismissed leaving it open to the petitioner to invoke appropriate remedies available to him under the statute in accordance with law.

Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
