THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.7835 of 2010 ORDER:
This Writ Petition is filed for the following relief: "For the reasons stated in accompanying affidavit, the Hon'ble Court it may be pleased to issue order or direction more particularly on in the nature of WRIT OF MANDAMUS declaring the action of the Respondent No.3 in taking the petitioners to the police station, detaining them for hours together and interfering with their peaceful life and liberty by coercing them to produce Md.Habeeb, S/o.Fakruddin (absconded Accused No.1 in S.C. No.678/2007 pending on the file of Hon'ble IV Additional Sessions Judge, Mahabubnagar) as illegal, arbitrary, without jurisdiction and has the effect of violating the fundamental rights guaranteed to the petitioners u/s 14 & 21 of the Constitution of India and consequently direct the Respondents not to interfere with the peaceful life and liberty of the petitioners without following due process of law and pass any such other order or orders as the Hon'ble Court may deems fit and proper in the interest of justice."
2. On 08.04.2010 this Court while admitting the writ petition passed the following interim order in W.P.M.P. No.10061 of 2010: "Respondent No.3 is directed not to interfere with the life and liberty of the petitioners only on account of absconding of Md.Habeeb, S/o.Fakruddin, (accused in Sessions Case No.678 of 2007 pending on the file of the IV Additional Sessions Judge, Mahabubnagar).
