HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.30028 OF 2016 ORDER:

When the matter is taken up for hearing, it has been noticed by this Court that the award passed by the Labour Court has already been implemented and the workman was reinstated into service vide proceedings dated 10.09.2016. In exercise of powers under Section 11-A of the Industrial Disputes Act, the Labour Court had only directed for reinstatement of the workman as 'afresh Badli Filler', without back wages. As the workman was already reinstated into service, at this stage this Court is not inclined to interfere with the award passed by the Labour Court, Hence, the writ petition is dismissed. No costs.
