HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.2633 of 2011 ORDER:

This writ petition is filed to declare the impugned proceedings No.E2/785(1)/09-DY.CPM/VJA, dated 10.12.2009 issued by the 3rd respondent as highly illegal, arbitrary, unreasonable and discriminatory and without any application of mind and also in violation of Articles 14, 16 & 21 of Constitution of India and consequently direct the respondents to consider the case of the petitioner for promotion to the post of Junior Assistant as per the final seniority list of conductors of Vijayawada City Division as on 01.09.1990 and with all consequential attendant benefits.

2. Sri A.Sai Sushil Reddy, representing Sri C. Rajashekar Reddy, learned counsel for the petitioner, submits that the cause in the writ petition does not survive.

3. Recording the said submission, the writ petition is dismissed as infructuous. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition shall stand dismissed.
