The present transfer petition, under Section 24 of the Code of Civil Procedure, 1908, is filed seeking to withdraw O.P.No.1743 of 2015 from the file of Judge, Additional Family Court, City Civil Court, Hyderabad, and transfer the same to the file of Judge, Family Court, Nalgonda, Nalgonda District.
2. Heard Sri M.V. Hanumantha Rao, learned counsel for the petitioner - wife.
3. Despite service of notice, none appears for the respondent.
4. The respondent - husband filed O.P.No.1743 of 2015 on the file of Judge, Additional Family Court, City Civil Court, Hyderabad, seeking dissolution of marriage.
5. Learned counsel for the petitioner would submit that the petitioner is suffering with spinal cord problem, which causes compression on her legs, and, therefore, it is difficult for her to travel to Hyderabad to defend the O.P. He would further submit that the petitioner is employed as a Teacher.
6. Keeping in view, the spinal cord problem projected by the petitioner, there is every reason to accede to the request of the petitioner. Therefore, the request of the petitioner is acceded to.
7. Accordingly, the present transfer petition is allowed. Consequently, O.P.No.1743 of 2015 pending on the file of Judge, Additional Family Court, City Civil Court, Hyderabad, is withdrawn and transferred to the file of Judge, Family Court, Nalgonda. The transferee Court shall issue notices to the parties on receipt of the case bundle and dispose of the O.P. in accordance with law. Miscellaneous Petitions, if any, pending in this transfer petition shall stand closed. There shall be no order as to costs. ___________________________ A. SHANKAR NARAYANA, J April 16, 2018.
