THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.6354 of 2008 ORDER:

This Writ Petition was filed challenging the declaration issued under Section 6 of the Land Acquisition Act by proceedings dated 01.03.2008 published on 04.03.2008. It is brought to the notice of this Court that in respect of the same declaration other owners of the land whose names found place in the said declaration approached this Court in W.P.Nos.5771, 6355, 6356, 6358 and 6361 of 2008 and this Court, by order dated 09.09.2011, while setting aside the declaration to the extent of the lands owned by the petitioners therein permitted them to file objections for the proposed acquisition before the Land Acquisition Officer within a period of two weeks from the date of disposal of the said Writ Petitions.

The Land Acquisition Officer was directed to conduct an enquiry into the objections filed by the petitioners and send appropriate report to the second respondent therein and basing on the said report, further steps were directed to be taken up.

Acquisition Officer and the Land Acquisition Officer is directed to consider the said objections and pass appropriate orders thereon in accordance with law within a period of four weeks and submit a report to the second respondent, who shall act on such report in accordance with law.

The Writ Petition is, accordingly, allowed to the extent indicated above. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
