HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.M.P Nos.2050 of 2015 and 2051 of 2015 IN/ AND Crl.P. No.868 of 2015 COMMON ORDER :

Pending disposal of the Criminal Petition, to quash the proceedings of S.C No.392 of 2010 on the file of Assistant Sessions Judge, Nellore SPSR Nellore District, outcome of the report of 2nd respondent-de facto complainant herein, that resulted police investigation and filing of final report and its taking of cognizance and committing to Court of Sessions, in turn cognizance taken under Section 193 Cr.P.C by the learned Assistant Sessions Judge and from the hearing charges framed and trial conducted, the case ended in conviction against the petitioners herein and impugning the conviction judgment, Crl.A.No.88 of 2007 filed by them. It is pending the same in their attempt to seek for compounding of the non-compoundable offences before the Sessions Judge filed, held they are not entitled and there from they filed the application seeking permission.

2) The de facto complainant and the petitioner No.1 are present and stated that in the year 2011 itself, after conviction judgment, petitioner No.1 married the de facto complainant herein and they are living together and also blessed with a male child by name Dayasagar in their wedlock. As they are living together being man and wife happily and the case is coming in the way of their leading

amicable marital life, sought permission for compounding. 3) Having regard to the above facts and circumstances and to serve the ends of justice by invoking Section 482 Cr.P.C, permission is accorded. Accordingly, the Crl.P.M.P. Nos.2050 of 2015 and 2051 of 2015 are ordered.

4) Consequently, the Criminal Petition is allowed and all the proceedings relating to Crl.A.No.88 of 2011 on the file of VI Additional District and Sessions Judge, SPSR Nellore District, are quashed with a direction to record the fact closing the appeal docket. The bail bonds of the petitioners 1 and 2, if any, shall stand cancelled.

5) Miscellaneous petitions, if any pending in this Criminal Petition, shall stand closed.
