This writ petition is filed by the petitioner to direct the respondents to consider the enhancement of age of superannuation up to 65 years for all the teachers working in Universities and colleges as per the decision of the Government of India in Letter dated 23.03.2007 and also for alternative relief to treat the lecturers working in Government/Affiliated/Aided colleges on par with the teaching staff working in the Universities for the purpose of age of superannuation and to further direct the respondent authorities to continue the petitioner in service up to the age of 65 years pending decision by the state Government on the letter dated 23.03.2007.

Heard the submissions of the learned counsel for the petitioner. Perused the material record.

This Court, on 30.06.2010, dismissed WPMP No.23915 of 2007 holding that the petitioner is not entitled to any relief, considering the fact that he was, by then, 61 years of age. The Writ Petition was admitted on 03.09.2007. No counter is filed. In the facts and circumstances, the issue involved has become stale and does not require adjudication at this stage. It is fairly conceded that the petitioner was retired from service on attaining the age of superannuation, 60 years.

In that view of the matter, the writ petition is dismissed as infructuous as no cause survives for adjudication.
MSRM, J W.P.No.18635 of 2007 Miscellaneous petitions pending, if any, in this writ petition shall stand closed.
