THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 18486 of 2016 ORDER:

The present writ petition came to be filed with the following prayer:

'For the reasons stated in the accompanying affidavit, the petitioner herein prays that this Hon'ble Court may be pleased to issue a writ order or direction more particularly one in the nature of writ of Mandamus declaring the action of respondent Nos.2 to 4 in not seizing the pass port bearing No.M1929716 dated 12.09.2014 of the Venkataraju Narayanappa in Crime No.5 of 2016 dated 09.02.2016, registered under Section 498-A of IPC and Sections 3 and 4 of Dowry Prohibition Act by respondent No.4 as illegal, arbitrary, unconstitutional and pass such other order or orders as this Hon'ble Court may deem fit and proper in the circumstances of the case.'

It is to be noted that this Court by order dated 16.03.2016 in Crl.P.No.3165 of 2016, while granting anticipatory bail to the husband of the petitioner, directed him not to leave the country without prior permission of the Court concerned. Learned counsel for the petitioner submits that inspite of the said condition, there is every likelihood of the husband of the petitioner leaving the Country, if the passport is not directed to be deposited in the Court.

Since the petitioner is seeking imposition of certain conditions besides the conditions imposed in the order dated 16.03.2016, it will be appropriate if she moves the same before the appropriate criminal Court.

Having regard to the circumstances stated above, the

petitioner shall move an application before the appropriate Court seeking imposition of certain conditions in addition to the conditions imposed in the order dated 16.03.2016, or file a fresh application for deposit of passport in which event, the same shall be dealt with, in accordance with law, at the earliest.

Accordingly, the writ petition is disposed of. Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs.
