HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.8748 OF 2015 ORDER:
The petitioners complain against inaction of 3rd respondent in completing the enquiry pending before him in File No.Rc.G2/7929/01. The grievance of the petitioners is that the respondents acquired the land belonging to the petitioners for road widening and without paying proper and market value compensation have taken possession of the land. The Arbitration proceeding is pending in Case No. Rc.G2/7929/01. Only notices are issued and enquiry is not completed, much less any order is passed. On account of inaction, the petitioners claim to be suffering irreparable loss and hardship.
The learned Government Pleader has received written instructions of even date. From the written instructions, it is evident the enquiry in the arbitration proceedings under the National Highways Act is pending with the 3rd respondent. As the possession was taken several years back, I consider it appropriate to direct the 3rd respondent to complete the enquiry and pass award in File No.Rc.G2/7929/01 within a period of two months from the date of receipt of a copy of this order.
The writ petition is disposed of. No order as to costs. Miscellaneous petitions, if any, pending in the writ petition shall stand closed. ___________ S.V.BHATT, J Date:31.03.2015 Stp
