HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.21865 OF 2016 ORDER:

This writ petition is filed to declare the action of the respondents in not taking any action against the Extension Officer (PR & RD), Chimakurti and Panchayat Secretary, Yerragudipadu Grampanchayat, Prakasam District, who have not conducted the Gram Panchayat meeting on 04.05.2016 without consent of the petitioner being Sarpanch, as illegal, arbitrary and violative of the instructions and rules issued by the Government. The case of the petitioner is that he is the Sarpanch of Yerragudipadu Gram Panchayat, Chimakurthy Mandal, Prakasam District. It is stated that the Panchayat Secretary has issued notice to him on 04.05.2016 calling him to attend the meeting without giving any particulars of the meeting, and accordingly, the petitioner attended the meeting.

It is stated that when the petitioner is present in the meeting, he is the chairperson, but the Panchayat Secretary, without the consent of the petitioner being Sarpanch, has entered the resolutions in the minutes book, and when the petitioner asked him to handover the minutes book, he refused to do so and kept in his custody. It is therefore stated that the action of the Panchayat Secretary is illegal, arbitrary and against the provisions of Panchayat Raj Act and as such the petitioner made a representation on 04.05.2016 to respondent No.4 to take action against the Extension Officer (PR & RD), Chimakurthy and Panchayat Secretary, Yerragudipadu Gram Panchayat, Prakasam District, but so far no action has been taken. Aggrieved by the same, the present writ petition is filed.

Heard learned counsel for the petitioner and learned Government Pleader.

In view of the facts and circumstances of the case and having regard to the fact that the petitioner has already made a representation on 04.05.2016, the writ petition is disposed of directing the respondent concerned to dispose of the petitioner's representation dated 04.05.2016 within a period of three weeks from the date of receipt of a copy of this order by giving an opportunity of being heard to the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any pending in the writ petition, shall stand

closed.
