THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL REVISION CASE No.3151 OF 2016 ORDER:

This Criminal Revision Case is filed under Section 397 read with 401 of Cr.P.C. challenging the order dated 24.10.2016 passed in Crl.M.P.No.194 of 2014 in C.C.No.350 of 2011 on the file of the Court of the Special Judicial First Class Magistrate for PCR cases, Warangal.

When the matter is taken up for hearing, the learned counsel for the petitioners seeks permission of this Court to permit the petitioners to withdraw the criminal revision case. He further submitted that the presence of the petitioners before the trial Court may be dispensed with. There is no dispute with regard to the identity of the petitioners. Even if their presence is dispensed with, no prejudice will be caused to the respondent. Hence, permission is granted as prayed for.

Accordingly, the Criminal Revision Case is dismissed as withdrawn. The presence of the petitioners, who are accused Nos.2 to 7 in C.C.No.350 of 2011, before the trial Court is hereby dispensed with on each and every date of adjournment. However, they shall appear before the trial Court as and when their presence is so required.
