HON'BLE SRI JUSTICE T. SUNIL CHOWDARY TRANSFER C.M.P.No.42 of 2017 ORDER:

This petition is filed under Section 24 C.P.C., seeking to withdraw F.C.O.P.No.156 of 2015 on the file of the Judge, Family Court, Rajahmundry, East Godavari District, and transfer the same to the file of Judge, Family Court, Eluru, West Godavari District, for disposal in accordance with law.

Heard both the counsel and perused the material available on record.

At the time of arguments, learned counsel for the respondent submitted that the matter pertains to 2015, if it is transferred, it may take some more time for disposal. Learned counsel for the petitioner submitted that the respondent may be directed to pay some amount to the petitioner whenever she appeared before the Family Court, Rajahmundry. 4.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. 5.

Having regard to the facts and circumstances of the case, the respondent is hereby directed to pay an amount of Rs.1,000/ - (Rupees one thousand only) to the petitioner whenever she appeared before the Family Court, Rajahmundry in F.C.O.P.No.156 of 2015. The learned Judge, Family Court, Rajahmundry, is hereby directed to dispose of F.C.O.P.No.156 of 2015 as expeditiously as

possible, preferably, within a period of six months from the date of receipt of copy of this order.

With the above direction, the transfer C.M.P. is disposed of. As a sequel, miscellaneous petitions, pending if any shall stand closed.
